Convention of States- What should you remember when drafting a constitutional amendment? Professor Natelson is a leading authority on a Convention of States. By Professor Rob Natelson Via i2i.org- Last month, Citizens for Self Governance sponsored a simulated convention for proposing amendments in Williamsburg, Virginia. I was an adviser for the project, and just before the initial meeting I spoke to the assembled commissioners. My purpose was to provide them with some last-minute tips on drafting proposed constitutional amendments. Several people have asked me to post my remarks on … [Read more...]

Proposed Rules For An Article V Convention Of States
In July 2015, Professor Rob Natelson, one of the nation’s leading Article V experts, crafted an initial draft of rules for a Convention of the States along with Convention of States Project co-founder, Michael Farris. Since then, members of the Convention of States Caucus -- a group of 200+ state legislators from 40 states, all united in their support of an Article V Convention of States -- have been invited to review Natelson’s rules and provide input. The following is the latest iteration of those rules as of September 2015. When a Convention of States is called, these rules will be … [Read more...]

More Evidence An Article V Convention is a “Convention of the States”
By Rob Natelson Via Independence Institute- Earlier this year, I documented one of the reasons we know an Article V convention is a “convention of the states” rather than a mass popular gathering: Founding Era documents tell us so. I listed several such documents. (Subsequent to the Founding, in the case of Smith v. Union Bank, the Supreme Court also referred to an Article V convention as a “convention of the states.”) Here is another piece of evidence: In 1788, New York ratified the Constitution, but the state ratifying convention called for extensive amendment. In a circular letter to … [Read more...]

Nullification? The Experts Weigh In
As I go around trying to be a Paulette Revere by discussing the possibility of using Article V to have a convention of the states, I inevitably run into friends and neighbors who have been turned against it by groups like the John Birch Society or more reputible web sites such as the Eagle Forum. Many have been convinced by groups like the Tenth Amendment Center and books by Tom Woods that nullification would be the preferable option. Even after Michael Farris debated the JBS clearing up all of their objections, I still run into people both live and on social media who try to say amending the … [Read more...]

Free Convention Of States eBook By World Expert Rob Natelson
By Rob Natelson Via his site A spate of new applications from state legislatures for a “convention for proposing amendments” make it more likely that we will have an amendments convention in the near future. In order to get ready for this historic event, lawyers, legislators, and others involved in the process need a reliable guide to the law governing amendment conventions. Citizens for Self Governance has just published my legal treatise on the subject as part of their Convention of States project. It is called A Compendium for Lawyers and Legislative Drafters. In addition to over 80 … [Read more...]

Obamacare, An Unconstitutional Conspiracy
How a Conspiracy Cracked a Monopoly By Rob Natelson - Via Constitution I2I.org - Anyone interested in the constitutional debate over the “Affordable Care Act” should pick up a copy of the new book, A Conspiracy Against Obamacare: The Volokh Conspiracy and the Health Care Case. This “conspiracy” was not a political plot or an illegal combination. Rather, it is one of the nation’s two top constitutional law websites—a blog called the Volokh Conspiracy, founded by UCLA law professor Gene Volokh. The book is about more than constitutional arguments over Obamacare. It is also about the … [Read more...]

Is a Convention of States Politically Possible?
By Michael Farris Via American Thinker - Mark Levin's book, The Liberty Amendments, has sparked the hope that American citizens can save the Republic by calling a Convention of States under Article V. Two classes of naysayers have arisen. First, there are those, like my dear friend Phyllis Schlafly, who argue that using the power of the states under Article V is dangerous and could result in a runaway convention. Professor Rob Natelson has decisively answered this contention here. James W. Lucas represents the second class of critic -- those who contend that it is politically impossible to … [Read more...]
